Terms of Service

By using TradieMate (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Allan Poynton ("we", "us", "our").

TradieMate provides:

• Automated SMS text-back when a customer calls your business number and you do not answer.
• Automated Google review request SMS sent to your customers after a job is completed.
• A dashboard to view missed calls, customer conversations, reviews, and ROI statistics.
• Editable message templates for both automations.

The Service is billed as a monthly subscription at $300 AUD per business per month, with a 14-day free trial. No payment is required during the trial.

• Your subscription is processed by Stripe and auto-renews monthly until cancelled.
• You can cancel at any time — cancellation takes effect at the end of your current billing period.
• Refunds are issued at our discretion for billing errors or service outages.
• Prices may change with 30 days' notice via email. Existing subscribers keep their current price.

You agree to:

• Provide accurate business information when onboarding.
• Ensure you have consent to send SMS to your customers under the Spam Act 2003 (Cth).
• Use the Service only for your own business — not resell or white-label it.
• Keep your login credentials secure and not share them.
• Comply with all applicable Australian laws and regulations.
• Not use the Service to send unsolicited spam or fraudulent messages.

The Service relies on call forwarding from your business phone number to a Twilio number. You are responsible for configuring call forwarding on your phone (we provide instructions). We are not liable for missed calls if call forwarding is not set up or stops working due to your phone carrier.

SMS messages are sent via Twilio. We are not liable for SMS delivery failures caused by carrier issues, network outages, or the recipient's phone being off or out of range.

You agree NOT to:

• Use the Service to send misleading, fraudulent, or illegal content.
• Send SMS to customers who have opted out or asked not to be contacted.
• Attempt to access other users' data or compromise the Service's security.
• Reverse engineer, decompile, or copy the Service's code or design.
• Use the Service in a way that infringes on someone else's intellectual property.

The TradieMate name, logo, software, and all associated intellectual property belong to Allan Poynton. You retain ownership of your business name, your message content, and your customer data. We retain a licence to process your data solely for the purpose of providing the Service.

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for:

• Lost revenue, lost jobs, or lost business opportunities.
• SMS delivery failures or call forwarding issues.
• Downtime, data loss, or service interruptions.
• Any indirect, incidental, or consequential damages.

Our total liability for any claim is limited to the amount you have paid us in the 3 months preceding the claim.

You can cancel your subscription at any time. We can suspend or terminate your access if you breach these Terms, if your account is inactive for 12 months, or if we discontinue the Service (with 30 days' notice). Upon termination, your data will be deleted within 30 days.

Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms by reference.

We may update these Terms from time to time. We will notify you of material changes by email or via your dashboard at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
